  21. <p>     Sam Goldwyn used to say that "a verbal agreement isn't
  22. worth the paper it's written on." Last week a Los Angeles jury
  23. found differently. It ruled that actress Kim Basinger (912
  24. Weeks, Batman) had breached an oral contract when she backed out
  25. of a commitment to star in the film Boxing Helena, and ordered
  26. her to pay $8.9 million in damages to the producers, Main Line
  27. Pictures.

  29. <p>     Hollywood was shocked by the price but not by the verdict.
  30. "This is an oral town," notes one veteran agent, "a town of
  31. relationships." You take a lunch, you shake a hand, you make a
  32. movie.
  33. </p>
  34. <p>     Boxing Helena is a thriller about a surgeon so obsessed
  35. with a woman that he amputates her limbs and puts her in a box.
  36. After Madonna backed out of the title role, director Jennifer
  37. Lynch discussed it with Basinger. Lynch assured the actress that
  38. the nude scenes would be tasteful: "I wanted to photograph her
  39. like a work of art."

  41. <p>     Lynch never got to do that. Basinger exited, and Main
  42. Line's Carl Mazzocone had to return the $7.6 million raised on
  43. the star's name. Her replacement, Twin Peaks' Sherilyn Fenn,
  44. could lure only $2.7 million. "I'm not a $100 million
  45. corporation that they don't want to screw with," Mazzocone says.
  46. "I'm just a little independent." For now, he is a rich little
  47. independent.

  49. <p>     Basinger's lawyer, Howard Weitzman, insists no deal was
  50. consummated. "When you want to do a project," he says, "the
  51. dance begins. The jury thought the dance was already over. But
  52. Kim and the producers had not settled on the pay-or-play part
  53. of the deal." If they didn't yet have to pay, why should she
  54. have had to play?
  55. </p>
  56. <p>     The immediate effect of the jury's decision will probably
  57. be more detailed memos and CYA (cover your ass) letters. "I'm
  58. going to be much more conscious of the words," says the veteran
  59. agent. " `Love you, babe' will take on a new meaning."
